- INTERPRETATION AND VARIATION
1.1 In the terms and conditions the following definitions apply:
“TG” means Therapy Guide Ltd (trading as Therapy Guide)
“Therapist” means any person who is a member of Therapy Guide and is listed on the website.
“Client” means any person who has booked an appointment, or made an enquiry on the site about undertaking therapy.
“Session” means the appointment arranged between Therapist and Client facilitated via Therapy Guide.
“Successful Referral” means a client attending and paying for their first session with the Therapist.
“Terms and Conditions” as defined here.
“Website” means www.therapyguide.com or affiliated websites.
1.2 The Terms and Conditions are also incorporated into the Client Consent Form.
1.3 TG reserves the right to vary or revoke any of the Terms and Conditions from time to time, which we may consider necessary or suitable for the regulation of the Website and the conduct of Therapists and Clients.
1.4 The Terms and Conditions shall be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.
CLIENTS
- General Guidelines
2.1 By providing an email address to TG on registration, the Client consents to receiving email communications from TG, including notices relating to the Terms and Conditions.
2.2 The Client also accepts any risk that email may not be a fully secure and confidential means of communication.
2.3 TG will not be liable for any loss or damage suffered as a result of communicating with a Client via email.
2.4 The Client agrees to thoroughly read and comply with our Terms and Conditions set out within.
2.5 The Client agrees to thoroughly read and sign the TG Consent Form.
2.6 The protection of our Client’s safety is paramount. Safeguarding is a key facet of our ethics - any breach of trust will not be tolerated. If you have any concerns please let us know immediately. We will investigate and take appropriate action. Client safeguarding is the responsibility of the Therapist and the relevant governing bodies.
- PAYMENT OF FEES
3.1 Subject to any statutory right of cancellation, payments for Sessions are made non‐refundable unless otherwise stated in the Terms and Conditions.
3.2 Payment for a Session must be made at least 48 hours before the appointment takes place. If payment has not been received by the required time TG or the Therapist, at their discretion, will not go ahead with the Session.
3.3 Cancellation must be made at least 2 working days before the appointment is due to take place. Failure to do this will result in a 100% cancellation fee.
3.4 The Client will make payments for all appointments to TG.
- THERAPY GUIDE CLIENT CONSENT FORM
4.1 TG accepts that Clients have a fundamental right to:
4.2 Receive sufficient information to enable an informed decision.
4.3 Withdraw consent at any stage without prejudice to future services.
4.4 In order to use the services TG provides we have to collect your personally identifiable information - such as, but not limited to: your name, phone number, email address, postal address, billing and payment information, and profile information.
4.5 Your consent is necessary as a lawful basis for processing your information, we have a transparent service in which the Client has a full understanding of the data we obtain and the reasons for doing so.
4.6 Protecting your information is a top priority for us. We will never sell or rent any information shared with TG. To see the details about how we process and protect your Data, click here.
- THERAPISTS
5.1 Subject to condition 2.2, when a person has been accepted to the site they shall become a Therapist subject to these Terms and Conditions.
5.2 Acceptance of a person as a Therapist is at the discretion of TG.
5.3 Therapists must act at all times in a professional manner towards Clients. Any behaviour deemed unacceptable or inappropriate towards Clients will be dealt with strictly by TG, who reserve the right to withdraw or suspend any Therapist whose conduct is deemed unbecoming of their profession.
5.4 A Therapist should not engage in any outside activity which could be considered detrimental to TG’s reputation or bring TG into disrepute. TG therefore reserves the right to withdraw or suspend any Therapist whose conduct is, or may be deemed to be in TG’s reasonable opinion, damaging to the character of TG; or amounts to a breach of the Terms and Conditions; or where such expulsion is otherwise to be in the interests of the other Therapists of TG.
5.5 A Therapist should not book a Client’s sessions directly. If we are notified by our algorithm that a Therapist has taken a booking from a TG Client without going through TG we will contact both parties immediately to clarify. We will suspend your TG profile until the situation has been clarified. If we find evidence of a breach it will be taken extremely seriously, we will inform our legal team and take action accordingly.
5.6 The protection of our Client’s safety is paramount. Safeguarding is a key facet of our ethics - any breach of trust will not be tolerated. If we are notified by a Client of any concerns we will investigate and take appropriate action. Client, and personal, safeguarding is the responsibility of the Therapist and the relevant governing bodies.
- PAYMENT TERMS
6.1 Details of assessment and appointment prices are agreed before inclusion of a Therapist onto our Website. TG charges a fee in addition to the Therapist fee, which is agreed by email before Therapist profiles are made live. Payment of Client fees is collected by TG.
- SERVICES, FEES, AND CONDITIONS
7.1 The Therapist will receive a Client’s appointment confirmation via the Website. The Client normally chooses their Therapist from the Website and pays the initial fee online. If the Client makes an enquiry to the TG Support Team, TG will place the Client with the Therapist they believe is most suited to the Client’s needs based on the information they have provided and what is known about the Therapist
7.2 TG does not charge a Therapist to be part of our services, instead, a fee is added to the Therapist's fee. These fees will be agreed before a Therapist’s profile is made live.
7.3 The Client will make payments to TG. The Therapist then invoices TG at the end of each month for the previous month’s appointments.
- YOUR COMMITMENT TO US
8.1 We are aiming to provide the most welcoming and reassuring environment for Clients who have taken the step to seek help and have enquired about therapy. Therefore, it is essential that these people do not go unanswered. As such we ask that:
8.2 The Therapist’s diary should be kept strictly up to date to enable Clients to book their appointments online.
8.3 The Therapist provides a minimum of 6 hours of availability per week.
8.4 Appointment confirmations should be acknowledged by the Therapist to the Client as soon as possible. If the time and/or date needs re-arranging for any reason this should be done as soon as possible.
8.5 The Therapist should confirm to the Client how the Session will be carried out, i.e. by Zoom, other video link, etc and send any details required.
8.6 The Therapist is responsible for attending appointments on time. Should the Therapist not attend a scheduled appointment, it is the Therapist's responsibility to reschedule the appointment in the same week. If this is not possible a fee will incur.
8.7 The Therapist will sometimes be asked to provide an article for our Website, or a video for social media, normally only once a month.
8.8 Once a month we will spotlight a Therapist of our choosing on our Website homepage. This therapist will be recommended to clients.
- OUR WEBSITE
When using our website:
9.1 You agree to seek our written permission if you would like to link to our website or copy our content in any way, shape or form. By supplying us with material via digital or hardcopy, you allow us unlimited, royalty free use of its content.
9.2 You agree not to reproduce, distribute, modify or re-post our content on another Website; frame or mirror our Website; or link to our Website without our prior written consent.
9.3 You grant to us a non-exclusive, irrevocable, royalty-free, worldwide licence to use (including but not limited to: publishing and modifying) any material you email, post or submit to us.
For the avoidance of doubt, we will be free to use any ideas, concepts, know-how, content, and text or images contained in your communications with us for any purpose whatsoever, to the fullest extent permitted by law.
9.4 We try to update our Website regularly, so we may have to suspend access, service or functionality from time to time, without notice. If required, we may have to close our Website indefinitely. We will not be liable if, for any reason, our Website is unavailable at any time or for any period of time.
9.5 You agree not to do anything that does or may interfere with the proper working of the Website including, but not limited to: tampering with, or hacking into the Website or the servers on which it resides.
9.6 You agree to thoroughly read and comply with our Terms and Conditions set out within. Anyone infringing on the aforementioned terms could be excluded from the use of our Website and services.
- DISCLAIMER
10.1 TG is acting as a referral and management system.
10.2 TG takes no responsibility for outcomes of therapeutic Sessions.
10.3 The Therapist is responsible for the Client assessment.
